Agreement between ltaly and Morocco for Economic and Technical Cooperation

Preamble

The Government of the Italian Republic and the Government of the Kingdom of Morocco, motivated by the desire to facilitate the realization of a program of economic and technical cooperation between the two Governments, both in the public and private sectors, have agreed as follows:

Body

Article 1.

The Government of the Italian Republic will facilitate the realization of the proposals that the Government of the Kingdom of Morocco considers useful to put forward concerning the participation of Italian industry and technology in the economic development of the Kingdom of Morocco. In particular, the two Governments will facilitate initiatives aimed at studying and setting up programs to develop in Morocco, through the employment of Italian technicians and equipment, the construction of public works, the communications system and the exploitation of economic resources.

Article 2.

In the realization of the above initiatives the Government of the Kingdom of Morocco will guarantee to the Italian companies operating in Morocco, a treatment no less favorable than that granted to the companies and initiatives of any other country because of the legislation and regulations in force and the existing conventions between these countries and the Kingdom of Morocco as regards the transfer of salaries, income and capital to be repatriated.

Article 3.

The Government of the Italian Republic will facilitate the employment of Italian technicians and specialists in Morocco on the basis of agreement between the Government of the Royanne duMaroc on the one hand, and Italian technicians and specialists on the other. The Government of the Italian Republic is also willing to provide all necessary assistance for the training of Moroccan technicians in Italy.

Article 4.

The Government of the Italian Republic is willing to grant Italian companies, upon request, authorizations for the supply of capital goods to Moroccan state and private companies, in accordance with the legislation in force in Italy, on the basis of installment payments. The Government of the Kingdom of Morocco will provide the necessary guarantees for the transfer, at each due date, of the sums due to the Italian creditors, in accordance with the legislation in force in Morocco, for credits deriving from the supply of capital goods by Italy.

Article 5.

In order to facilitate the implementation of the economic and technical cooperation program provided for in this Agreement, a Joint Commission for Economic Cooperation will be set up, composed of representatives of the two Governments and Italian and Moroccan technicians. The Commission will have a permanent Secretariat with headquarters in Rome and Rabat.

Article 6.

The Joint Commission provided for in Article 5 will meet at least every three months to examine the projects drawn up in accordance with this Agreement. The Joint Commission will benefit from the collaboration of the competent authorities of both countries and will submit to the two Governments documented recommendations on the projects to be implemented. The Joint Commission will promote the exchange of ideas and technical information between the two countries and will carry out, in particular, a profitable action of technical cooperation in the following forms:

a) exchange of information on economic legislation;

b) exchange of publications and technical information;

c) exchange of experts;

d) transfer of patent rights and licensing of patents;

e) specialization of technicians and workers;

f) transfer of technical documentation;

g) collaboration between economic, technical and scientific bodies;

h) collaboration between companies and organizations of the two countries in the fields of industry, agriculture, construction, transport and trade;

i) study missions.

Article 7.

This Agreement shall enter into force on the day of its signature and shall have a duration of two years. It shall be tacitly renewed from year to year until either of the High Contracting Parties denounces it with three months' notice.

The denunciation of this Agreement shall not affect the validity of contracts already concluded and guarantees already given under it.
